By downloading, installing, or using the Tiny Match mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Tiny Match ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such changes constitutes acceptance of the modified Terms.
You must be at least 13 years of age to use Tiny Match. If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you represent and warrant that you meet the eligibility requirements.
To use certain features of the App, you must create an account using Apple Sign-In, Google Sign-In, or email authentication. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
Tiny Match is provided for personal, non-commercial use. You may use the App to browse baby names, match with your partner, create shortlists, and other features as described within the App.
You agree not to:
Tiny Match offers a free tier with limited features and a premium tier ("Tiny Match Premium") that unlocks additional features including partner matching, unlimited swipes, super likes, advanced filters, head-to-head comparisons, family voting, and daily picks. Tiny Match Premium is available as a one-time lifetime purchase ($14.99) or a monthly subscription ($7.99/month).
All subscriptions and in-app purchases are processed through Apple's In-App Purchase system. By subscribing to Tiny Match Premium, you agree to Apple's terms and conditions for in-app purchases.
If you choose the monthly subscription, Tiny Match Premium is auto-renewable. Your subscription will automatically renew at the end of each monthly billing period unless you cancel at least 24 hours before the end of the current period.
We may offer free trial periods for Tiny Match Premium. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
All purchases are processed by Apple. Refund requests must be submitted directly to Apple through their standard refund process. We do not have the ability to issue refunds for App Store transactions.
The App, including its design, features, content, baby name database, code, graphics, logos, and trademarks, is owned by Tiny Match and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our written permission.
You retain ownership of any content you create within the App, such as notes, reactions, and shortlist arrangements. By using the App, you grant us a limited, non-exclusive license to store and process this content solely for the purpose of providing the App's features to you and your paired partner.
The App integrates with the following third-party services:
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, completeness, or reliability of any content, including baby name data, meanings, origins, or popularity information provided through the App.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TINY MATCH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Tiny Match and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:
You may terminate your account at any time by deleting your account within the App or by contacting us at support@tinymatch.app.
Your use of the App is also subject to Apple's standard End User License Agreement (EULA) for Licensed Applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall take precedence with respect to matters governed by Apple's EULA.
You also acknowledge and agree to the terms set forth in our End User License Agreement page.
Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Pennsylvania, United States.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action.
These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Pennsylvania for any legal proceedings arising from these Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and Tiny Match regarding your use of the App and supersede all prior agreements, communications, and understandings.
