This End User License Agreement ("EULA") is a legal agreement between you ("User") and Tiny Match ("Licensor," "we," "our," or "us") for your use of the Tiny Match mobile application ("App"), available through the Apple App Store.
By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not download, install, or use the App.
Important: Your use of the App is also governed by Apple's Licensed Application End User License Agreement ("Apple Standard EULA"), which is incorporated into this agreement by reference.

In the event of any conflict between the terms of this EULA and Apple's Standard EULA, Apple's Standard EULA shall prevail with respect to matters governed therein.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.

The App and all intellectual property rights therein are and shall remain the property of Tiny Match. This includes but is not limited to the App's code, design, graphics, user interface, baby name database, and trademarks. This EULA does not grant you any ownership rights in the App.
The App offers a free tier and a premium tier (Tiny Match Premium) available through Apple's In-App Purchase system, offered as a one-time lifetime purchase or a monthly auto-renewable subscription. Purchase terms, pricing, auto-renewal, and cancellation are described in our Terms of Service. All payments are processed by Apple, and Apple's terms govern the purchase transaction.
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will function without interruption or error, that defects will be corrected, or that the App is free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY MATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE PRECEDING TWELVE MONTHS, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
The App may integrate with third-party services including Firebase, RevenueCat, Sentry, Apple Sign-In, and Google Sign-In. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
We may also terminate or suspend your license at any time for any reason. Termination does not entitle you to a refund of any subscription fees already paid.
You acknowledge and agree that Apple, Inc., and its subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Tiny Match is solely responsible for providing maintenance and support services for the App, as described in this EULA, or as required under applicable law. Apple has no obligation to furnish any maintenance or support services for the App.
This EULA shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to conflict of law provisions.
